Copyright Infringement Policy
HostGator takes intellectual property rights very seriously and it is our
policy to respond to clear notices of alleged copyright infringement. This
Copyright Infringement Policy describes the information that should be
present in these notices. It is designed to make submitting notices of
alleged infringement to us as straightforward as possible while reducing the
number of notices that we receive that are fraudulent or difficult to
verify.
To file a take-down notice with us, you must provide a signed written
communication by email, fax or regular mail, that includes your full contact
information and sets forth the items specified below.
Your name, mailing address, telephone number, facsimile number (if any)
and email address;
Sufficient information to enable us to identify the allegedly infringing
material and its online location (e.g., URL where the allegedly infringing
material is found);
A statement that you require HostGator to remove or disable access to the
material;
A statement that you, in good faith, believe that the material
infringes your copyright;
A statement that the information in the take-down notice is
accurate;
A statement that you are the copyright owner or exclusive licensee or
that you are authorised to act on behalf of such owner or exclusive
licensee;
A statement that you agree to submit to the jurisdiction of the courts in
Singapore;
Your signature;

Please note that you will be liable for damages (including costs and
attorneys' fees) if you materially misrepresent that material is infringing
your copyright. Accordingly, if you are not sure whether material available
online infringes your copyright, we suggest that you first contact an
attorney.
HostGator may respond to take-down notices by removing or disabling access
to the allegedly infringing material and/or by terminating services. If we
remove or disable access in response to such a notice, we will make a
good-faith attempt to contact the owner or administrator of the affected
site or content so that the owner or administrator may make a counter
notification.
HostGator may document notices of alleged infringement it receives and/or
on which we action is taken. As with all legal notices, a copy of the notice
may be made available to the public and sent to one or more third parties
who may make it available to the public.
Upon receipt of notice from HostGator that a claim of infringement has been
made and/or that the material has been removed or that access to it has been
disabled, the User may provide a counter notice.
To be effective, a counter-notice must include ALL of the following
information:
Name, mailing address, telephone number, facsimile number (if any) and
email address of the respondent;
Information to enable HostGator to identify the material removed or to
which access was disabled including the online location before such
material was removed or disabled;
a statement that the respondent, in good faith, believes that the
material was removed or access was disabled as a result of mistake or
misidentification or that the material does not infringe the
Complainant’s copyright;
a statement that the information in the counter-notice is accurate;
and
agreement that the User submits to the jurisdiction of the Singapore
courts.
Upon receiving a proper counter-notice, HostGator will take reasonable
steps to restore the material in 10-14 business days unless the copyright
owner commences court proceedings to prevent the restoration of the material
and HostGator is informed of such proceedings.
